徵收條例規定公告30天案 大法官：違憲

（中央社記者劉世怡台北31日電）嘉義市一名遭徵收的民眾想改領「抵價地」，卻因晚收到公函通知而逾期聲請。大法官今天認定土地徵收條例部分違憲，要求一年內沒有檢討修正，條文將失效。

嘉義市98年辦理湖子內區段徵收開發，公告8月3日到9月3日為止，但一位民眾在8月5日才收到公函，並於9月4日提出申請，要求政府補償他「抵價地」，但被市府已超過公告30日為由駁回。民眾經行政爭訟敗訴確定後，向大法官會議聲請釋憲。

大法官會議指出，土地徵收條例規定是以「公告」起算，但實際上土地所有權人收到通知書（公函）的時間，一定是在公告日後，也因此這種申請期限的起算日，不符憲法要求的正當行政程序，違反憲法保障人民財產權意旨，應在1年內檢討修正。1040731
